Traipse Coach Tours — booking Terms

Welcome to Traipse Coach Tours. These Terms & Conditions outline the agreement between you, the traveller, and Traipse Coach Tours, a partnership between Ian McKenzie and Tracey Kisvarda. 

By booking a tour through our website or our booking partner Rezdy, you acknowledge that you have read, understood, and agreed to these Terms.

Nothing in these Terms affects your rights under the Australian Consumer Law (ACL). 

Our services are supplied in accordance with the Competition and Consumer Act 2010 (Cth).  

Nothing in these Terms limits or excludes your consumer guarantees under the ACL. 

A booking is confirmed when payment is made through Rezdy and you receive a confirmation email. 

Prices are in Australian dollars (AUD) and may vary until paid in full. 

Processing or card fees may apply, disclosed prior to payment. 

All cancellations must be made in writing or through your Rezdy booking link.

Refunds are processed in accordance with the ACL. 

Rezdy transaction fees are non-refundable unless required by law.

We may cancel or amend a tour if minimum numbers are not met or if events beyond our control occur (e.g., severe weather, natural disasters, or government restrictions).

If we cancel, you may choose a refund, credit, or alternate date.

Our liability is limited to monies paid. 

We are not responsible for delays or cancellations due to events beyond our control (including weather, strikes, health emergencies, or mechanical failure). 

We may retain unrecoverable supplier costs. 

You must follow instructions from our staff and behave respectfully toward others. 

We may refuse service or remove any traveller behaving unlawfully or unsafely, without refund. 

You are responsible for damage caused by your actions. 

Participation in tours or activities involves inherent risks of injury, illness, property damage, or death.
You participate voluntarily and accept these risks to the extent permitted by law.

WARNING UNDER THE AUSTRALIAN CONSUMER LAW AND FAIR TRADING ACT 2012 (VIC)

Under the law, a supplier of recreational services is entitled to ask you to agree that the supplier is not liable for death or personal injury resulting from the failure of the supplier to comply with a guarantee under the Australian Consumer Law (Victoria).

By signing this form, you agree that your rights to sue the supplier under the Australian Consumer Law (Victoria) if you are killed or injured because the services were not supplied with due care and skill or because the services were not reasonably fit for their purpose are excluded, restricted, or modified in the way set out in this form.

Note: This does not apply if your death or injury is due to gross negligence.

To the maximum extent permitted by law:

• We are not liable for loss, damage, injury, delay, or consequential loss caused by third-party suppliers or events beyond our control .
• Our total liability for any claim is limited to the amount you paid for the booking. 
• You indemnify Traipse Coach Tours, Ian McKenzie, and Tracey Kisvarda against all claims arising from your breach or negligence, except where caused by our own negligence.

Accommodation, attractions, and transport may be supplied by independent operators. 

We act as agent only, and their own conditions apply. 

Comprehensive travel insurance covering cancellations, medical expenses, and personal effects is strongly recommended.

Luggage is carried at your risk. 

We are not liable for theft or damage except where caused by our negligence. 

We collect and handle your personal information in accordance with the Privacy Act 1988 (Cth) and the Australian Privacy Principles.

Bookings are processed via Rezdy, which acts as our booking platform.

We do not share your personal data except as necessary to deliver your travel services.
Marketing emails are sent only with your consent and always include an unsubscribe link (Spam Act 2003 (Cth)). 

If you experience any issue during your tour, please notify your tour leader or our office immediately.

Unresolved matters may be referred to your state’s consumer affairs agency. 

These Terms are governed by the laws of Victoria, Australia. 

Any disputes shall be heard in the courts of that state, unless otherwise required by the ACL.
